Terms of Service

These terms apply when you use Biashara AI, a WhatsApp bookkeeping assistant operated by Zenvora Technology Solutions Limited ("we", "us"). By using Biashara AI, you agree to these terms.

1. The service

Biashara AI helps you record sales and expenses, produce business reports, and get business information through WhatsApp. Features differ by plan, as described in our pricing section and in the quotation you receive when you reply UPGRADE.

2. Your account

• Your account is linked to your WhatsApp number. You are responsible for activity on that number.
• You must be at least 18 and using the service for a genuine business.
• You must give accurate information, and only send records you have the right to share.

3. Plans and payment

• New accounts get their first month free, with all features. After the free month, the service continues only on a paid plan; if it is not paid, the account pauses after 3 days and its records are kept.
• Paid plans are billed monthly through M-Pesa at the price shown in your quotation.
• After a successful payment we send you a payment receipt. Official eTIMS tax invoices are issued separately.
• You can stop paying at any time. Your paid features continue until the end of the period you paid for.
• We may change prices in the future. We will tell you before a change affects you.

4. Important limits on reports and information

• Reports are prepared from the information you give us. They are only as accurate as that information.
• Financial statements produced by Biashara AI are for your own management use. They are not audited or certified, and are not a substitute for a qualified accountant, tax adviser or lawyer.
• Market prices and similar information come from online research and may not be current or accurate. Check important figures before you rely on them.
• Biashara AI uses artificial intelligence, which can make mistakes. Please review your records and tell the assistant if something is wrong so it can be corrected.

5. Acceptable use

Do not use Biashara AI to break the law, to send harmful or abusive content, or to try to disrupt or misuse the service. We may suspend accounts that do.

6. Your data

Your business records belong to you. We use them only to provide the service, as explained in our Privacy Policy. You can ask us to delete your data at any time; see Data Deletion.

Chama accounts. The person who sets up a chama account confirms that they are authorised by the chama to keep its records, and that its members have agreed to their details being recorded. The chama, through its officials, decides what is recorded, corrected or removed in its book, and handles members' requests about their records. Biashara AI keeps records only: it does not hold, collect, lend or transfer money, and it is not a bank, SACCO or other financial institution. Interest and fines are calculated using the rules the chama enters; the chama is responsible for those rules and for its own decisions.

7. Availability

We work to keep Biashara AI available, but it depends on services run by others, including WhatsApp and M-Pesa, and it may sometimes be unavailable. We may change or improve features over time.

8. Liability

To the extent the law allows, we are not liable for indirect losses, or for decisions you make based on reports or information from the service. Nothing in these terms limits rights you have under Kenyan consumer protection law.

9. Ending the service

You can stop using Biashara AI at any time. We may suspend or end access if these terms are broken.

10. Governing law

These terms are governed by the laws of Kenya.
